Terms of Service

These Terms of Service ("Terms") govern your use of Ore, including the Ore desktop apps for macOS and Windows, our websites and the related cloud services (together, the "Service"). The Service is provided by hecara ("hecara", "we", "us"). By creating an account, downloading or using Ore, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Ore is an AI voice dictation app. It turns your speech into text, cleans up and formats that text, can translate it, and includes Ore Agent, an AI assistant. Most features need an internet connection because speech recognition and AI processing run in the cloud.

We may add, change or remove features over time. Some features may be labelled as beta or experimental and may be less reliable.

2. Your account

  • You must provide accurate information and keep your password secure. You are responsible for activity under your account.
  • An account is for one person. Each plan allows a limited number of signed-in devices.
  • You must be at least 13 years old, or the minimum age required to consent to data processing where you live, to use the Service.

3. Plans, usage limits and Agent credits

Ore offers a Free plan and a paid Pro plan. Each plan includes monthly allowances for dictation time, text cleanup and Ore Agent credits, as shown on our pricing page and in the app. Agent credits are used according to the actual processing each Agent request requires, so different requests may use different amounts. Allowances reset monthly and unused allowances do not carry over.

To keep the Service reliable for everyone, we apply rate limits and may limit or suspend use that is automated, excessive or abusive.

4. Payments, renewals and refunds

  • Payment processing. Payments are processed by Stripe. Payments for Ore are currently collected through a Stripe account registered to an individual in Hong Kong SAR who operates hecara, so the merchant name on your card or bank statement may reflect that account. Prices are shown before you pay and may be displayed in your local currency. Applicable taxes may be added.
  • Subscriptions. Pro subscriptions paid by card renew automatically at the end of each billing period at the then-current price until you cancel. You can cancel at any time from your account or the billing portal; cancellation takes effect at the end of the current billing period and you keep Pro until then.
  • Fixed-term purchases. Pro purchased for a fixed period (for example with Alipay or WeChat Pay) does not renew automatically. If you buy another period before the current one ends, the new period starts when the current one ends.
  • Refunds. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods or unused allowances. If you believe you were charged in error, contact us within 14 days of the charge and we will review it.
  • Price changes. We may change prices. Changes to an existing subscription take effect from your next billing period, and we will notify you in advance.

5. Using your own model or API keys

Ore Agent can connect to an AI model or web search service that you configure with your own API key. When you do this, your requests are sent directly from your device to that provider. You are responsible for your use of that provider, including its terms, its charges and the content it returns. We are not responsible for third-party services you choose to connect.

6. Acceptable use

You agree not to:

  • use the Service for anything illegal, or to infringe the rights of others;
  • record or process another person's voice or information without any consent required by law;
  • create or distribute malware, spam, or content that is harmful, abusive or deceptive;
  • reverse engineer, decompile or disassemble Ore, except where the law permits it;
  • circumvent usage limits, device limits, payment or security measures, or access the Service through unauthorized automation;
  • resell, sublicense or redistribute the Service without our written permission.

7. Your content

You own the audio you record, the text you dictate and the results Ore produces for you ("Your Content"). You give us a limited permission to process Your Content only as needed to provide, secure and support the Service, as described in our Privacy Policy. We do not use Your Content to train our own AI models.

You are responsible for Your Content and for how you use it.

8. AI output

Speech recognition, text cleanup, translation and Ore Agent responses are generated automatically and may be inaccurate, incomplete or inappropriate. Review results before you rely on them, and do not rely on them as professional advice (including legal, medical or financial advice) or for decisions where errors could cause harm. Check code and commands before you run them.

9. Intellectual property

Ore, including its software, design, logos and documentation, is owned by hecara and its licensors and is protected by law. We grant you a personal, non-exclusive, non-transferable licence to use Ore in line with these Terms. Ore includes open-source components, which are licensed under their own terms. If you send us feedback, we may use it without obligation to you.

10. Third-party services

The Service relies on third-party providers, such as cloud hosting, speech recognition, AI model, payment and email providers. Their availability can affect the Service. We are not responsible for failures of third-party services that are outside our reasonable control.

11. Suspension and termination

You can stop using Ore and ask us to delete your account at any time. We may suspend or end your access if you breach these Terms, if required by law, or to protect the Service or other users. Where reasonable, we will tell you first. Sections that by their nature should continue (including 7 to 9 and 12 to 14) survive termination.

12. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not promise that the Service will be uninterrupted, error-free or always accurate.

13. Limitation of liability

To the fullest extent permitted by law, hecara will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue or business, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim arose, or USD 50. Nothing in these Terms limits liability that cannot be limited by law.

You agree to indemnify hecara against claims arising from your misuse of the Service or your breach of these Terms.

14. Governing law and disputes

These Terms are governed by the laws of Singapore. Before starting any formal proceedings, please contact us so we can try to resolve the issue informally. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of Singapore, unless the law where you live gives you the right to bring proceedings there.

15. Changes to these Terms

We may update these Terms. If a change is material, we will notify you in the app or by email before it takes effect. Continuing to use the Service after the change takes effect means you accept the updated Terms.

16. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Service.
